Ditching the Disclaimer

Do you need that big disclaimer in your email signature? No, you don’t. The overwhelming consensus among contract lawyers is that disclaimers will not protect you. However, if it’s too big a leap to ditch them altogether, here are two tweaks: 1) Put it at the TOP of your email body, not at the end of your email; 2) Link to your site’s disclaimer with text such as “Please refer to our website [link to site] for our policies and disclaimers regarding electronic communications.” Here’s an entertaining parody of a lawyer-written email disclaimer, but which makes several serious points:

This site is in-your-face powerful. Their homepage text tells you immediately what they do: “Fighting for Victims of Sexual Assault, Blackmail, and Stalking – Online and Off”. They use edgy language, extremely engaging graphics, and excellent “calls to action” to get you to click deeper into the site. Their main navigation bar items are atypical and highly effective. Worth every minute of your time to check out.
